1. Introduction and Scope

Welcome to Creation Genius. These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and Creation Genius ("Company", "we", "us", or "our"), governing your access to and use of the creationgenius.com website, the Creation Genius WordPress plugin, and our proprietary AI-orchestration API (collectively, the "Service").

By installing the plugin, registering an account, or accessing our backend API, you acknowledge that you have read, understood, and agreed to be bound by these Terms. If you are using the Service on behalf of a company or organization, you represent that you have the authority to bind that entity to these Terms.

2. Technical Requirements & Connectivity

The Creation Genius Service is designed as a cloud-integrated WordPress solution. To utilize the Service, the following technical conditions must be met:

• Public Hosting Requirement: Your WordPress installation must be hosted on a public server accessible via the live internet. Use of the Service on localhost, private intranets, or firewalled development environments is strictly unsupported.
• Domain Validation: Each API key is cryptographically tied to a specific domain. Attempting to use a single key across multiple domains without authorization is a violation of these Terms.
• System Environment: You must maintain a compatible environment (minimum PHP 7.4 and WordPress 6.2). We are not responsible for service interruptions caused by outdated server software or conflicting third-party plugins.

3. AI Content Orchestration & Model Selection

Creation Genius provides a sophisticated abstraction layer for multiple Large Language Models (LLMs). Our backend engine utilizes an automated selection logic to determine the most efficient and high-quality model (including but not limited to versions of Anthropic Claude, OpenAI GPT, and Google Gemini) for each specific user query.

4. Fees, Future Charges, and Billing

Transition to Paid Service: You acknowledge that while the Service is currently offered in a "Free Beta" or promotional phase, the Service will become chargeable in the near future. Creation Genius reserves the right to implement a tiered subscription model or usage-based pricing at its sole discretion.

• Subscription Terms: Upon the introduction of paid tiers, continuing to use the Service will require valid payment information.
• Automatic Renewal: Paid subscriptions will renew automatically unless cancelled via the Service dashboard at least 24 hours prior to the billing date.
• Refund Policy: Due to the digital and computational nature of AI generation (where costs are incurred instantly upon request), all fees are non-refundable unless required by law.

5. Absolute Right to Restrict Access

To ensure the stability of the platform and prevent abuse of AI resources, we maintain absolute control over account access:

• Discretionary Limits: We may impose "reasonable limits" on the number of generations per hour, day, or month for any account, even those on "unlimited" plans, to prevent bot-activity or resource exhaustion.
• Banning and Blocking: We reserve the absolute right to ban, block, suspend, or terminate any user, account, or domain from accessing the Service at any time, for any reason, without notice and without liability. Reasons may include, but are not limited to: suspicious request patterns, generation of prohibited content, or failure to comply with technical requirements.

6. Intellectual Property & Usage Rights

Ownership of Output

Upon successful generation and delivery, Creation Genius assigns to you all rights, title, and interest in the specific text and structure of the Generated Content. You may use this content for commercial or personal purposes.

Ownership of Platform

Creation Genius retains all ownership of the "Orchestration Logic," the WordPress plugin code, the backend API structure, the UI/UX design, and all trademarks and branding. You are granted a limited, revocable license to use the plugin as intended.

7. Prohibited Uses

You agree not to use the Service to:

• Generate content that is illegal, harmful, threatening, or promotes hate speech.
• Circumvent any technological measures or usage quotas.
• Develop a competing AI content orchestration service using our API.
• Submit prompts that violate the intellectual property rights of any third party.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. WE EXPRESSLY DISCLAIM ANY WARRANTIES REGARDING THE SEARCH ENGINE RANKING (SEO) OR TRAFFIC PERFORMANCE OF CONTENT GENERATED BY OUR AI.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL CREATION GENIUS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO THE USE OF, OR INABILITY TO USE, THIS SERVICE.

10. Indemnification

You agree to defend, indemnify, and hold harmless Creation Genius and its subsidiaries, agents, licensors, managers, and other affiliated companies, from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from your use of the Service or any Generated Content published on your website.

11. Governing Law & Jurisdiction

These Terms shall be governed by and defined following the laws of India. You and Creation Genius irrevocably consent that the courts of India shall have exclusive jurisdiction to resolve any dispute which may arise in connection with these terms.
